Legal Help After An Animal Attack
A dog bite is an extremely traumatic experience that can leave victims scarred and seriously injured or even paralyzed for life. Unfortunately, the majority of animal attacks are against children. Most adults have a better sense of when a dog is about to attack, and they get out of the area. Children don’t pick up these cues as well, so they innocently wander near dogs or unwittingly do things to agitate the animals. Animal attacks on children are particularly tragic.
We can help you. At The Herman Firm, we bring a wealth of experience and a strong commitment to helping our clients and their families after animal attacks. Our attorney, Michael D. Herman, has been handling a range of injury claims in Walnut Creek and the Bay Area of California for nearly a decade. We take a personalized approach marked by compassion and dedication. When you work with our law firm, we will walk you through the entire legal process and make sure you understand your rights and options as we fight to get you the compensation you deserve.
Dog Bite Liability In California
One of the first questions people have after a dog bite is whether the dog owner is liable for the damages. California is a “strict liability” state. In many states, dog bite victims have to jump through some hoops before they can collect compensation. The biggest hoop is that they have to show that the dog owner either knew or should have known that the dog had a propensity for violence or a likelihood that the dog would attack someone.
California, as a strict liability state, does not have that requirement. Dog owners are strictly liable. If someone’s dog attacked you or one of your children, the dog owner is presumed to be responsible and liable for this attack.
We have helped many families recover compensation after dog bite incidents and other animal attacks.
